{"id":491,"date":"2023-10-31T17:00:07","date_gmt":"2023-10-31T16:00:07","guid":{"rendered":"https:\/\/ns-adwokaci.adheads.dev\/korzystny-wyrok-w-sprawie-frankowej\/"},"modified":"2026-05-24T14:07:01","modified_gmt":"2026-05-24T12:07:01","slug":"favorable-judgment-in-the-swiss-franc-case","status":"publish","type":"post","link":"https:\/\/ns-adwokaci.pl\/en\/favorable-judgment-in-the-swiss-franc-case\/","title":{"rendered":"Favorable judgment in the \u201eswiss franc case\u201d"},"content":{"rendered":"<div id=\"modal-ready\" class=\"aktualnosci-pop-tresc\">\n<p>Recently, the Firm has obtained another favorable decision of the Court of Appeal in Krakow, Civil Division representing a borrower fighting for his rights in the so-called \u201eSwiss Franc case\u201d.<\/p>\n<p>In December 2022, the Firm\u2019s client won a dispute with BNP Paribas Bank Polska S.A., Warsaw branch as the legal successor to Bank Gospodarki \u017bywno\u015bciowej S.A. in Warsaw regarding a 2008 loan agreement. The District Court in Krak\u00f3w found the Swiss franc denominated loan agreement invalid. BNP Paribas was ordered to pay the Firm\u2019s client an aggregate amount of PLN559,489.74, CHF 1,718.04, as well as accrued interest and trial costs. Thus, the adjudicating courts fully accepted the claim for payment submitted by the Firm\u2019s client and determined the non-existence of the legal relationship arising from the loan agreement \u2013 including for the future.<\/p>\n<p>In justifying the validity of the Firm\u2019s client\u2019s claims, the court referred to clauses prohibited in loan agreements, finding them unfavorable for borrowers and invalidating the loan agreement.<\/p>\n<p>File number I ACa 699\/23; I C 1435\/2<\/p>\n<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Recently, the Firm has obtained another favorable decision of the Court of Appeal in Krakow, Civil Division representing a borrower fighting for his rights in the so-called \u201eSwiss Franc case\u201d.
