{"id":552,"date":"2021-01-26T08:32:12","date_gmt":"2021-01-26T07:32:12","guid":{"rendered":"https:\/\/ns-adwokaci.adheads.dev\/korzystny-wyrok-trybunalu-sprawiedliwosci-unii-europejskiej\/"},"modified":"2026-05-24T14:06:37","modified_gmt":"2026-05-24T12:06:37","slug":"the-court-of-justice-of-the-european-union","status":"publish","type":"post","link":"https:\/\/ns-adwokaci.pl\/en\/the-court-of-justice-of-the-european-union\/","title":{"rendered":"The European Court of Justice delivers a positive result for the Firm\u2019s client"},"content":{"rendered":"<div id=\"modal-ready\" class=\"aktualnosci-pop-tresc\">\n<p>The Court of Justice of the European Union (the \u201cCJEU\u201d) delivered a judgement in the case concerning the legal interpretation of the concept of \u2018discrimination\u2019 under Article 2 of Directive 2000\/78\/EC, after the court\u2019s proceedings before the Grand Chamber and after the positive opinion handed down the advocate general Giovanni Petruzelli, which opined \u2013 in line with the Firm\u2019s position in the case \u2013 that the principle of equal treatment in the European Union law (\u201cEU Law\u201d) is intended to efficiently and effectively protect workers who have a disability against any discrimination on the basis of such disability \u2013 not only compared to workers who do not have disabilities but also compared to other workers with disabilities. The CJEU\u2019s ruling is hugely important not only for the Firm\u2019s Client but also for other cases concerning anti-discrimination law. The CJEU\u2019s judgement further indicates that the principle of equal treatment may be also applied in cases of differentiation within a distinct group of workers with protected personal characteristics.
